Our planning committee met to discuss the approval of this development, and unanimously voted to appeal it, based on the significant relaxations of the rules of the Land Use Bylaw. The Appeal Notice is attached.

The building is to be built right at the edge of the present floodway and its location will act as a choke point, trapping flood debris between the building and the 25th Avenue bridge – thus having the potential to cause flood water to back up and flow through Forrest Park and through the properties to the south, as occurred during the 2013 flood. The building is also set well forward into the required 4m front setback, and thus too far forward on the lot, where it negatively impacts the streetscape. And finally, it is 1.73m or 5 feet 8 inches too tall. The specific relaxation details are available in the Approval Notice, circulated to you on October 9th – although the City failed to specify the height relaxation.

This file, the approved plans, and the terms of the appeal were also reviewed and discussed at our October 14th community meeting.

A procedural hearing is scheduled before the Subdivision and Development Appeal Board on November 6th. It will determine the amount of hearing time required, and schedule a date for a full board hearing.
