I received this Development Permit application and plans in this morning’s mail. A PDF of some of it is attached.

It is a single family home with a detached garage accessed off of the lane.

By way of background, the 2013 flood destroyed the original home at 48 – 27th Avenue SW. The owner applied for DP2014-2269 to build a new home, and after some changes to the plans, that DP was approved on August 20th, 2014 as a contextual development – meaning it essentially conformed to the homes around it. Construction of the home started after considerable delay.

Unfortunately the builder didn’t follow the approved plans, and instead built the house one metre too close to the front property line. In mid-October, 2015, the City issued a Stop Work Order on the project.

The homeowner has now applied for this new discretionary DP to approve the home as built.

I met with the owner a few weeks ago at her request, and suggested she consult with the neighbours on either side to obtain their opinion of this solution. She subsequently obtained a letter from the neighbour on either side, whereby they ‘do not have any concerns or disagreement with the residence being completed in the current location, and support the new application …’.
