The SDAB hearing was held today, July 11th, at 9AM. I presented on behalf of the ECA, and Brian Kiers read Lorna Jamison’s presentation (on behalf of herself and 14 neighbours)  into the record since she is on vacation.

Our community and adjacent neighbours basically lost this appeal. The building in the back yard will be constructed, and the front building height will remain the same, although the board disagreed with the Development Authority’s method of determining grade, as the starting point for building height. The board added a few conditions to the development permit to mitigate privacy issues for the neighbours to the West.

When the SDAB publishes the reasons for their decision, I’ll send one further email, with a copy of the written decision, in order to conclude this file.

The City approved this development permit. A PDF of the approval notice and associated documents is attached.

Approval DP2012-3695

I met with Alderman Carra, the developer, and the architect to review the approval this morning. The architect will provide an electronic version of the shadow study, which I will distribute when I receive it. Alderman Carra supports this development, and will supply us with his comments, which I will also forward when received.

Our planning committee will meet later this week to review this result, and prior to that I’ll discuss it with the neighbours that objected to the development at the outset.

The deadline for an appeal against this approval is May 8th, 2013.

I received this discretionary application in this morning’s mail.

To give you some background, this is the second multi-residential application for this property. An application for a 2 building, 4 unit design was rejected as the result of an appeal board decision announced in March, 2012. You can read the decision here: http://tinyurl.com/a3h5dsy.

On July 25th, Alderman Carra and I met with the developer for an early look at this latest proposal – basically a two-unit semi-detached building in the front yard and a single home, with parking for all three units in the back yard. The developer assured us that no bylaw relaxations would be required. As you will see in the attached PDF, the City’s review of the plans found a number of significant bylaw discrepancies.
