You may recall that the City reviewed the development permit application for this site and refused to issue a permit.

The developer appealed the City’s decision, hired a lawyer, and the Sub Division and Appeal Board hearing was held this morning. After a 3 hour hearing, the SDAB denied the appeal, and upheld the City’s decision. This development will not be built.

Our Community Association presented at the hearing.

When the SDAB publishes the reasons for their decision, I’ll send one further email with the link, in order to conclude this file.

The appeal hearing scheduled for today did not proceed. The developer hired a lawyer who requested an adjournment to May 30. The hearing will go ahead on that date. I don’t as yet know if it’s AM or PM. I’ll let everyone know.

On March 14th, the Development Authority refused this development permit.

I don’t know the reasons for refusal, however if I receive further information in writing, I’ll pass it along.

I received this Development Permit application and plans this morning. A PDF is attached.

There are multiple deficiencies noted as the result of the City’s review. The most notable are that the building is too far forward on the lot towards 28th Avenue, is too tall, and the top floors of the East elevation are not set back from the perimeter in order to reduce the massing and overlooking issues. In addition, I believe that the review may have missed Section 558(2)(c)(ii) – the requirement for visitor parking, Section 565(2)(a) – the requirement for a minimum 6 metre driveway length, and most importantly, failed to provide shadow studies. The latter is essential in order that the neighbours to the East, at #51 and #49, can understand the impact of the second and third units that overlook / overshadow their rear yards.

Furthermore, the driveways directly access Erlton Street, instead of having parking accommodated via the lane at the rear of the parcel.

The City comment states that this application meets the intent of the Erlton ARP. It clearly does not. There is also the perennial issue of pitched vs. flat roof design. Our ARP addresses it and the visitor parking issue on page 12, Site 1, guideline items 2(b) & (d). You can find the link to our ARP on our planning website:http://members.shaw.ca/erlton/
